1. Conclusion of the Package Travel Contract, Third-Party Services, Scope of Application and Definitions
1.1 Scope / Organizer

as the tour operator (hereinafter: “Organizer”), exclusively the following General Terms and Conditions apply in their version valid at the time of the travel registration. Deviating general terms and conditions of our customers shall not be recognized unless we expressly agree to their validity in writing. These conditions supplement §§ 651a–y BGB as well as §§ 4–11 BGB-InfoV and elaborate on them.
1.1.1 Conclusion of Contract
By registering for your trip, you make a binding offer to the Organizer to conclude the package travel contract.
The package travel contract is concluded upon receipt of the acceptance declaration by the Organizer. This does not require any specific form.
1.1.2 Travel Registrations via the Booking Form on spring-break-zrce.de
1.1.2.1 Booking Request
You can select various travel services from the Organizer’s range and submit a binding offer to conclude a package travel contract by clicking the button “Book now with obligation to pay” (booking request). Before submitting the booking request, you can view and change the data at any time.
However, the application can only be submitted and transmitted if you accept these contractual conditions by ticking the checkbox “I have read the Organizer’s GTC and agree to their validity.” and thereby include them in your application.
1.1.2.2 Acknowledgment of Receipt / Order Confirmation / Contract Confirmation
We will then send you an automatic acknowledgment of receipt by e-mail, in which your booking request is listed again and which you can print out using the “Print” function. The automatic acknowledgment of receipt only documents that your booking request has been received by us and does not constitute acceptance of the application. The contract is only concluded by our submission of the acceptance declaration, which is sent by a separate e-mail (order confirmation).
In this e-mail or in a separate e-mail, but at the latest upon provision of the travel services or allocation of a booking number, the contract text (consisting of booking request, GTC and order confirmation) will be sent to you by us on a durable medium (e-mail or paper printout) (contract confirmation).
The contract text will be stored in compliance with data protection.
1.2 Registration for Additional Participants
The registration is made by the registrant also for all participants listed in the registration, for whose contractual obligations the registrant is liable as for his own obligations, provided he has assumed a corresponding separate obligation by express and separate declaration.
1.3 Travel Confirmation / Deviations
Upon or immediately after conclusion of the contract, you will receive a written travel confirmation containing all essential details of the travel services you have booked.
If the confirmation deviates from your registration, the Organizer is bound by the new offer for 10 days.
The package travel contract is concluded on the basis of the new offer if you accept the offer within this period.
1.4 Reservations
Reservations are registrations for trips not yet advertised. They will be converted into firm bookings according to availability as soon as and to the extent the trip is bookable for the desired travel period.
1.5 Third-Party Services (Tickets)
If you only book a ticket from a third-party provider without further travel services, the Organizer acts only as an intermediary for a third-party service. By purchasing mediated tickets, contractual relationships arise exclusively between you and the respective provider. Please refer to the ticket for the name of the respective provider.
1.6 No Right of Withdrawal
You do not have a right of withdrawal pursuant to § 312g para. 2 no. 9 BGB (German Civil Code).
2. Payment
2.1 Insolvency Insurance / Security Certificate
To secure customer funds, the Organizer has taken out insolvency insurance with Zürich Insurance plc, Solmsstraße 27–37, 60486 Frankfurt am Main. A security certificate is included in the confirmation.
Furthermore, the amounts for down payment and balance payment and, if applicable, cancellation are shown in the confirmation.
2.2 Due Date for Isolated Booking of Accommodation
2.2.1 Down Payment
Upon conclusion of the contract, the down payment amounting to 20% of the total price becomes due against handing over the confirmation and is payable within 7 days from the conclusion of the contract. The costs for any travel insurance are due in full together with the down payment.
2.2.2 Balance Payment
The remaining price is due and will be debited 5 weeks before the start of the trip if it is certain that your trip will be carried out as booked and the travel itinerary (for ticketless travel) or travel documents will be sent to you as agreed. For last-minute bookings (from four weeks before travel start), the full travel price is due immediately.
2.2.3 Fees
The fees in case of cancellation (see clause 7) and processing and rebooking fees (see clause 8) become due immediately.
2.3 Due Date for Package Tours Including a Flight
For package tours including a flight, the travel price is due in full immediately upon conclusion of the contract against handing over the confirmation.
2.4 Due Date for Mediation of Tickets and Airport Transfers
When booking only mediated travel services, such as tickets for mediated events (e.g., festival tickets), or for isolated bookings of an airport transfer, the price is due in full immediately upon conclusion of the contract against handing over the confirmation.
2.5 Payment to the Organizer
2.5.1 Payment Methods
We offer the following payment methods: PayPal, SEPA direct debit, giropay, SOFORT transfer, credit card, and payment on invoice.
2.5.2 SEPA Direct Debit Mandate
If and insofar as the Organizer offers payment by SEPA direct debit, it requires a so-called “mandate” that authorizes the debit of your current account with the amount to be paid (down payment and balance payment) by direct debit. The mandate is part of the confirmation.
2.5.3 Credit Card
If and insofar as the Organizer accepts payment by credit card, it requires your address or, if applicable, the address of the document recipient as well as your consent to debit your credit card. A transaction fee of 0.7% of the travel price, rounded commercially to whole euros, applies to credit card payments. This does not apply to payments according to clause 2.6 or payments by direct debit.
2.5.4 Bank Transfer
You can also pay by bank transfer before the start of the trip. For this, the Organizer requires the first and last name, full address, telephone number, and e-mail address of the booker.
2.5.5 PayPal / Additional Fees
We also offer payment via the payment service provider PayPal. For payment methods other than SEPA core direct debits, SEPA business direct debits, SEPA transfers, and payment cards, the tour operator is entitled to charge additional fees to the customer for costs incurred by selecting this payment method. The amount of additional fees will be displayed during the ordering process.
2.6 (deleted)
2.7 Change of Payment Method
Changes to the agreed payment method can only be made up to 6 weeks before the start of the trip and only for outstanding payments.
2.8 Travel Itinerary / Travel Documents
If you have not received the travel itinerary (for ticketless travel) or, in exceptional cases, the travel documents by no later than 4 days before the start of the trip, please contact us immediately. For last-minute bookings or changes to the trip from 14 days before the start of the trip, you will receive a travel itinerary via the same channel as for longer-term bookings. For your own interest, please carefully check the travel itinerary (for ticketless travel) or the travel documents after receipt.
2.9 Default on Payment / Withdrawal / Reminder Fees
If due payments are not made or not made in full and you do not pay even after a reminder with a grace period, the Organizer may withdraw from the respective contract unless a significant travel defect already exists at this time. In case of withdrawal from the package travel contract as per the previous sentence, the Organizer may demand cancellation fees according to clause 7 as compensation.
If you do not make payments despite their due date, the Organizer also reserves the right to charge a flat reminder fee of €1.50 for the second reminder. You are free to prove that no or significantly lower costs were incurred.
2.10 Ancillary Services
Costs for ancillary services such as obtaining visas, etc., are generally not included in the travel price unless explicitly stated in the service description.
3. Services, Prices
3.1 Contractual Basis
The services contractually agreed upon result from the service descriptions (e.g., internet, catalog, flyer) and the related information in the confirmation (see clause 1.1 sentence 2). Before conclusion of the contract, the Organizer may change the service descriptions at any time, about which the traveler will of course be informed before booking.
3.2 Operating Airline / Community List
According to Regulation (EC) 2111/2005 of 14.12.2005, the Organizer is obliged to inform you at the time of booking about the identity of the operating airline(s). If the operating airline is not yet determined at the time of booking, you will initially be informed about the identity of the likely operating airline(s). As soon as the identity is finally determined, you will be informed accordingly. In case of a change of the operating airline after booking, you will be informed about the change as soon as possible.

3.3 Air Transport
The Organizer points out that direct flights may involve stopovers for flight and programmatic reasons. It is strongly recommended to carry money, valuables, technical devices, and medications exclusively in hand luggage.
3.4 Special Requests, Individual Travel Arrangements
3.4.1 Special Services
The Organizer will endeavor to accommodate your wishes for special services not listed in the service description (clause 3.1) (e.g., adjacent rooms or rooms in a specific location) if possible.
3.4.2 Fee for Individually Deviating Trips
A fee of up to €50 per traveler and week will be charged for processing individual trips deviating from the respective service description.
3.4.3 (repealed)
3.4.4 Rebookings at the Destination
For flight and/or hotel rebookings requested by travelers at the destination, the Organizer reserves the right, in addition to any additional costs incurred, to charge a reasonable processing fee per person.
3.4.5 Pets
Bringing pets is only permitted in cases where the service description explicitly allows it.
3.4.6 Uniform Catering
Please note that within one accommodation unit only identical catering services can be booked. This also applies to traveling children.
3.5 Extension of Stay
If you wish to stay longer at your holiday destination, please contact your tour guide or the local representative of the Organizer as early as possible. We will gladly extend your stay if appropriate accommodation and return transport options are available. The costs for an extension must be paid immediately on-site upon our request.
Please observe the tariff conditions associated with your return journey as well as the validity period of any travel insurance and any necessary visas.
3.6 Tour Guide, Support
For the offered trips, you will be supported on-site; in most holiday areas by tour guides of the Organizer or by local representatives of the Organizer (e.g., landlords of holiday apartments). Otherwise, you will find contact details in your travel itinerary (for ticketless travel), in your travel documents, or on spring-break-zrce.de.
In case of complaints, please observe the special instructions under clause 13.7.2.
4. Special Notes for Holiday Apartments, Holiday Homes and Campers
4.1 Additional Costs
Consumption-dependent additional costs or those for additional services requested by you are generally not included in the travel price. Unless otherwise stated in the service description, they must be paid directly on-site.
4.2 Occupancy
The holiday apartment/holiday home/camper may only be occupied by the number of adults and children specified in the service description and listed in the confirmation.
4.3 Arrival and Departure
The specified arrival and departure dates are binding.
4.4 Deposit
Upon handing over the keys, a reasonable amount (deposit) may be requested as security for possible damages or consumption-dependent additional costs payable on-site. The refund or offsetting takes place if the accommodation unit and inventory are returned in a properly cleaned condition at the end of the stay.
5. Child Discounts
5.1 Relevant Age
The relevant age is the child’s age at the start of the trip. Regardless, every traveling child and their age must be indicated at the time of booking.
5.2 Scope
Please refer to the respective service description for the scope of child discounts.
5.3 Incorrect Age Information
If incorrect age information is provided, the Organizer is entitled to subsequently charge the difference to the correct travel price plus a processing fee of €50. You are free to prove that no or significantly lower processing costs were incurred.
6. Changes to Services and Prices
6.1 Changes to Services
Changes to essential travel services compared to the agreed content of the package travel contract that become necessary after conclusion of the contract and are not caused by the Organizer in bad faith are only permitted insofar as they are not significant and do not impair the overall structure of the booked trip. Any warranty claims remain unaffected, especially insofar as the changed services are defective. The Organizer is obliged to inform the customer immediately after becoming aware of the reason for the change about essential changes to services. If applicable, the Organizer will offer the customer a free rebooking or free withdrawal.
6.2 Cruises
For cruises, the captain alone decides on necessary changes to the sailing time and/or routes, for example for safety or weather reasons.
6.3 Price Adjustments
The Organizer reserves the right to change the travel price agreed in the package travel contract in the event of an increase in transport costs or charges for certain services, such as port or airport fees, after conclusion of the contract as follows.
6.3.1 Increase in Transport Costs
If the transport costs existing at the conclusion of the package travel contract increase, especially fuel costs, the Organizer may increase the travel price according to the following calculation:
a) In the case of an increase related to the seat, the Organizer may demand the increase amount from the traveler.
b) In other cases, the additional transport costs charged by the transport company per means of transport are divided by the number of seats of the agreed means of transport. The resulting increase amount for the individual seat may be demanded by the Organizer from the traveler.
6.3.2 Increase in Charges
If the charges existing at the conclusion of the package travel contract, such as port or airport fees, are increased vis-à-vis the Organizer, the travel price may be raised by the corresponding proportional amount.
6.3.3 Preconditions
An increase according to clauses 6.3.1/6.3.2 is only permissible if more than 4 months lie between the conclusion of the contract and the agreed travel date and the circumstances leading to the increase neither occurred before conclusion of the contract nor were foreseeable for the Organizer.
6.3.4 Information / Rights of the Traveler
In the event of a subsequent change in the travel price, the Organizer must inform the traveler immediately. Price increases from the 20th day before the start of the trip are ineffective. For price increases of more than 8%, the traveler is entitled to withdraw from the package travel contract without fees or to demand participation in a trip of at least equal value if the Organizer is able to offer such a trip from its range without additional cost to the traveler. The reciprocal rights and obligations mentioned in this paragraph also apply in the case of a permissible change to an essential travel service.
6.3.5 Assertion
The traveler must assert these rights immediately after the Organizer’s declaration of the price increase or change of the travel service.
7. Withdrawal by the Traveler Before the Start of the Trip / Cancellation Fees
7.1 Declaration of Withdrawal
You may withdraw from the trip at any time before the start of the trip. The decisive factor is the receipt of the declaration of withdrawal by the Organizer (addresses see above under clause 1). It is recommended that you declare the withdrawal in writing.
7.2 Withdrawal / Non-Attendance
If you withdraw from the trip or if you do not start the trip, the Organizer loses the claim to the travel price.
Instead, the Organizer may, insofar as the withdrawal or non-attendance is not attributable to it and no case of force majeure exists, demand reasonable compensation depending on the respective travel price for the travel arrangements made up to the withdrawal/non-attendance and its expenses (cancellation fees). These cancellation fees are lumped in clause 7.5, taking into account the proximity of the withdrawal date to the contractually agreed travel start, as a percentage of the travel price. Usually saved expenses and the usually possible alternative use of travel services are taken into account.
7.3 Late Arrival / Missing Travel Documents
Cancellation fees are also payable if a traveler does not arrive on time at the respective departure airport or place at the times specified in the travel documents or if the trip is not started due to missing travel documents (e.g., passport or necessary visas) not attributable to the Organizer.
7.4 Proof of Lower Costs
You are free to prove that no or significantly lower costs were incurred in connection with the withdrawal or non-attendance than the costs indicated by the Organizer in the lump sum applicable in the individual case (see clause 7.5 below). The Organizer reserves the right to demand higher, concrete compensation deviating from the lump sums listed under clause 7.5. In this case, it is obliged to specify and substantiate the demanded compensation concretely, taking into account the saved expenses and any alternative use of the travel services.
7.5 Lump-Sum Cancellation Fees
The lump-sum claim for cancellation fees usually amounts per person/per accommodation unit in case of cancellations:
7.5.1 Standard Fees
Accommodation “Noa Glamping Resort”:
Cancellation is not possible free of charge. Postponement or name change of the booking is possible after consultation.
All other accommodations:
up to 10 weeks before the start of the trip: 25%
up to 8 weeks before the start of the trip: 50%
up to 7 week(s) before the start of the trip: 100%
7.5.2 Mediated Travel Services
For merely mediated travel services, especially tickets, the cancellation conditions of the respective provider apply, which will be communicated to you at the time of booking.
7.6 Combined Individual Services
If you have combined several services with individual prices (e.g., flight and round trip), the cancellation fees must be determined individually for each and then added together.
8. Rebooking, Replacement Person
8.1 Rebooking
At your request, the Organizer will, as far as feasible, make a change to the confirmation (rebooking) up to the 31st day before the start of the trip.
Rebookings include, for example, changes to the travel date, travel destination, place of travel commencement, accommodation, or transport.
A separate fee of €50 per person will be charged for this. Additional costs incurred vis-à-vis service providers (e.g., airlines) will be charged separately. Please also ensure the correct spelling of your name.
Furthermore, the following applies:
In the case of a change of transport, accommodation (except changes within the booked accommodation), or travel date, the travel price for the changed services will be recalculated completely based on the then applicable prices and conditions.
In the case of a change within the booked accommodation (e.g., change of room category, type of catering, or room occupancy of the booked room), the price for the changed services will be recalculated based on the prices and conditions underlying the booking so far.
Changes after the above-mentioned deadlines and changes beyond the validity period of the service description underlying the booking (clause 3.1) can only be made after withdrawal from the package travel contract under the conditions of clause 7.5 with simultaneous new registration.
8.2 Replacement Person
Until the start of the trip, the traveler may demand that a third party enters into his rights and obligations under the package travel contract.
This requires notification to the Organizer.
The Organizer may object to the third party’s entry instead of the traveler if the third party does not meet the special travel requirements or if legal regulations or official orders oppose his participation.
If a third party takes the place of the registered participant, the Organizer is entitled to charge a flat processing fee of €20 for the costs incurred by the participation of the replacement person. Additional costs incurred vis-à-vis service providers (e.g., airlines) will be charged separately. You are free to prove that no or significantly lower costs were incurred with the entry of the third party.
The registered participant and the replacement person are jointly and severally liable for the travel price and the costs arising from the entry of the replacement person.
9. Travel Insurance
The Organizer recommends taking out a comprehensive travel insurance package, especially including a (also separately bookable) trip cancellation insurance as well as insurance covering repatriation costs in case of accident or illness.
10. Withdrawal and Termination by the Tour Operator
10.1 Termination Due to Disturbance
The Organizer may terminate the package travel contract without notice if the execution of the trip is sustainably disturbed by the traveler despite a corresponding warning by the Organizer. The same applies if a traveler behaves so contractually in breach that immediate termination of the contract is justified. However, the Organizer retains the claim to the travel price. Any additional costs for return transport shall be borne by the disturber.
The Organizer must, however, credit the value of saved expenses as well as those benefits obtained from another use of services not claimed, including any refunds from service providers.
10.2 Withdrawal Before the Start of the Trip
The tour operator may withdraw from the contract before the start of the trip in the following cases:
Fewer persons than the minimum number of participants specified in the contract have registered for the package tour; in this case, the tour operator must declare the withdrawal within the period specified in the contract, but no later than:20 days before the start of the trip for a trip duration of more than six days,
seven days before the start of the trip for a trip duration of at least two and at most six days,
48 hours before the start of the trip for a trip duration of less than two days.
The tour operator is prevented from fulfilling the contract due to unavoidable, extraordinary circumstances; in this case, he must declare the withdrawal immediately after becoming aware of the reason for withdrawal.
The Organizer will inform you, of course, if it becomes apparent at an earlier date that the minimum number of participants cannot be reached. The declaration of withdrawal will be sent to the traveler immediately. You will then receive the paid travel price back immediately, at the latest within 14 days.
10.3 Remedy / Substitute Performance
In cases where the tour operator can refuse remedy (§ 651k para. 1 sentence 2 BGB), if the travel defect affects a significant part of the travel services, the tour operator must provide remedy by appropriate substitute performance (§ 651k para. 3 BGB). The tour operator must compensate for any reduction in value of the services, i.e., if the substitute performance is not equivalent, in money (reduction of the travel price).
If the traveler rightfully refuses the substitute performance, he may terminate the trip and assert the legal consequences of termination without the need for a termination declaration, or, if continuing the trip, claim a reduction and damages.
11. Extraordinary Circumstances, Force Majeure
11.1 Unavoidable, Extraordinary Circumstances
Regarding the termination of the package travel contract in cases of force majeure, we refer to § 651h BGB, according to which the tour operator cannot claim compensation if unavoidable, extraordinary circumstances occur at or near the destination that significantly impair the execution of the package tour or the transport of persons to the destination.
Circumstances are unavoidable and extraordinary within the meaning of this subtitle if they are not under the control of the party invoking them and their consequences could not have been avoided even if all reasonable precautions had been taken.
11.2 Travel Advisories
You can obtain travel advisories from the Federal Foreign Office on the internet at “www.auswaertiges-amt.de” as well as by telephone at (030) 5000-2000.
12. Notification of Defects, Remedy, Reduction, Termination
12.1 Demand for Remedy
If a travel service is not provided or not provided in accordance with the contract, the traveler may demand remedy. The demand for remedy must be addressed to the tour operator and must include a description of the defect and a request for its removal. The Organizer may refuse remedy if it is impossible (§ 651k para. 1 no. 1 BGB) or if remedy would involve disproportionate costs considering the travel defect and the value of the affected travel service (§ 651k para. 1 no. 2 BGB).
12.2 Reduction
The traveler may demand a reduction of the travel price if travel services have not been provided in accordance with the contract and he has not culpably failed to notify the defect immediately (without culpable delay).
12.3 Termination
If the trip is significantly impaired due to a defect and the Organizer does not provide remedy within a reasonable period, the traveler may terminate the package travel contract within the scope of the legal provisions – in his own interest and for evidentiary reasons, written form is recommended.
The same applies if the trip is unreasonable for the traveler due to a defect for an important reason recognizable by the Organizer.
Setting a deadline for remedy is only unnecessary if remedy is impossible or refused by the Organizer or if immediate remedy is required.
If the contract is then terminated, the traveler retains the claim for return transport. He only owes the Organizer the portion of the travel price attributable to the services used, provided these services were of interest to him.
13. Liability
13.1 Compensation
If a defect exists, the traveler may claim compensation without prejudice to the reduction of the travel price (reduction) or termination, unless the defect of the trip is due to a circumstance for which the Organizer is not responsible. He may also claim compensation for wasted holiday time if the trip is thwarted or significantly impaired.
13.2 Contractual Claims for Damages
The contractual liability of the Organizer for damages that are not personal injuries is limited to three times the travel price,
a) insofar as damage to the traveler is not caused intentionally or by gross negligence by the Organizer, or
b) insofar as the Organizer is responsible for damage to the traveler solely due to the fault of a service provider.
13.3 Tort Claims for Damages
For all claims for damages against the Organizer arising from tort that are not based on intent or gross negligence, liability for property damage is limited to the amount of three times the travel price.
These liability caps apply per traveler and trip. Possibly exceeding claims under the Montreal Convention or the Aviation Act remain unaffected by the limitation.
13.4 Liability for Third-Party Services
The Organizer is not liable for performance disruptions, personal and property damage in connection with services that are only mediated as third-party services (e.g., excursions, sports events, theater visits, exhibitions, transport services to and from the advertised departure and destination), if these services are clearly marked as third-party services in the travel advertisement and booking confirmation with the name of the mediated contractual partner so that they are recognizable to the traveler as not part of the Organizer’s travel service.
The Organizer is liable, however,
for services that include the transport of customers from the advertised departure location of the trip to the advertised destination, intermediate transport during the trip, and accommodation during the trip, as well as
if and insofar as a breach of duty to inform, clarify, or organize by the Organizer has caused damage to the customer.
13.5 Sports and Holiday Activities
You are responsible for your participation in sports and other holiday activities. Sports facilities, equipment, and vehicles should be checked before use.
The Organizer is only liable for accidents occurring during sports events and other holiday activities if it is at fault. The Organizer recommends taking out accident insurance.
13.6 Transport Conditions
Where advertised in service descriptions (clause 3.1), your travel itinerary (for ticketless travel) or travel documents include tickets of external transport companies. Transport is carried out on the basis of the conditions of the respective transport company, which will be made available upon request.
The rights and obligations of the Organizer and travelers under package travel law and these detailed travel conditions are not restricted by the conditions of the respective transport company.
Each traveler is responsible for arriving on time at the departure airport unless a delay is due to intentional or grossly negligent breach of duty by the Organizer.
13.7 Duty to Cooperate, Complaints
13.7.1 Duty to Cooperate
Each traveler is obliged, within the scope of the legal provisions, to cooperate in case of performance disruptions to avoid or minimize possible damages.
13.7.2 Complaints / Contact Persons
If you unexpectedly have grounds for complaint, this must be reported to the tour operator immediately on site and remedy requested. Our tour guide within the meaning of clause 3.6 sentence 1 or the contact person within the meaning of clause 3.6 sentence 2 is also entitled to receive these declarations.
If the tour guide or your contact person is not reachable, please contact the service provider (e.g., transfer company, hotelier, ship management) or the Organizer or its local representative. The necessary telephone and fax numbers as well as e-mail addresses can be found in your travel itinerary (for ticketless travel) or in your travel documents, in the service description (clause 3.1), or on spring-break-zrce.de.
For damages or delivery delays of luggage and goods on flights, the Organizer strongly recommends reporting them immediately on site, but no later than within 7 days after discovery of the damage for luggage, within 14 days after acceptance for goods, and in case of delay no later than 21 days after the luggage or goods have been made available to the traveler, by means of a damage report (P.I.R.) to the responsible airline. Airlines generally reject reimbursements if the damage report has not been completed.
Otherwise, loss, damage, or misdirection of luggage must be reported to the tour guide or the local representative of the Organizer.
As far as warranty rights under §§ 651i to 651n BGB are asserted, the deadlines according to clause 14.1 apply. In case of complaints, guests of holiday apartments/houses/suites must immediately request remedy from the contact person specified in the travel itinerary (for ticketless travel) or in the travel documents. If this is unsuccessful, please contact the nearest station of the tour guide or the local representative of the Organizer.
If the traveler culpably fails to notify a defect immediately, no reduction of the travel price occurs.
13.7.3 No Recognition of Claims
Tour guides are not authorized to recognize any claims.
13.8 Online Dispute Resolution
The European Commission provides a platform for online dispute resolution for consumer disputes at ec.europa.eu/consumers/odr/.
The Organizer currently does not participate in this voluntary alternative dispute resolution procedure and is not obliged to do so.
14. Deadlines, Addressees, Limitation and Assignment
14.1 Assertion of Claims
Claims due to non-contractual provision of the trip (§§ 651i to 651n BGB) must be asserted against the Organizer no later than one month after the contractually intended end of the trip. Exceptions are claims under § 280 para. 1, § 311, § 241 BGB or tortious as well as unjust enrichment claims.
Assertion should be made in writing in your own interest.
After the deadline, the traveler can only assert claims if he was prevented from meeting the deadline without fault. The day of the end of the trip is not included in the calculation of the monthly deadline.
For the registration of luggage damage, delivery delays of luggage or loss of luggage, see clause 13.7.2.
14.2 Limitation
14.2.1 Two Years
Claims of the traveler under §§ 651i to 651n BGB arising from injury to life, body, or health based on intentional or negligent breach of duty by the Organizer or a legal representative or vicarious agent of the Organizer expire after two years.
This also applies to claims for compensation for other damages based on intentional or grossly negligent breach of duty by the Organizer or a legal representative or vicarious agent of the Organizer.
14.2.2 One Year
All other claims under §§ 651i to 651n BGB expire after one year.
14.2.3 Start of Limitation
Limitation under the above paragraphs 14.2.1 and 14.2.2 begins on the day following the contractual end of the trip.
14.2.4 Tort
Claims arising from tort expire after three years.
14.2.5 Suspension
If negotiations between the traveler and the Organizer concerning the claim or the circumstances giving rise to the claim are pending, the limitation period is suspended until the traveler or the Organizer refuses to continue the negotiations. Limitation begins no earlier than three months after the end of the suspension.
14.3 Assignment
The assignment of claims against the Organizer is excluded. This does not apply among traveling family members or fellow travelers of a jointly registered group.
15. Passport, Visa, Customs, Currency and Health Regulations
15.1 Information
The Organizer will inform nationals of the EU member state in which the trip is offered about passport, visa, and health regulations and any changes before the trip. Nationals of other states should inquire at the embassies/consulates responsible for them.
15.2 Visas
The Organizer is not liable for the timely issuance and receipt of necessary visas by the respective diplomatic representation if you have commissioned it to obtain them, unless the delay is attributable to the Organizer. You should allow approximately 8 weeks to obtain visas, etc., from the competent authorities.
15.3 Personal Responsibility
The traveler is responsible for complying with all regulations important for the execution of the trip. All disadvantages, especially payment of cancellation costs, arising from non-compliance with these regulations are borne by him, except if caused by culpable false or missing information by the Organizer.
15.4 Travel Documents
Please refer to the service description (clause 3.1) to see whether a passport is required for your trip or if an identity card suffices, and please ensure that your passport or identity card has a sufficient validity period for the trip. Children require their own travel documents.
15.5 Customs and Currency Regulations
Customs and currency regulations are very strictly enforced in various countries. Please inform yourself carefully and comply with the regulations.
15.6 Vaccination Requirements
Certain vaccination certificates are required by various states, which must not be younger than 8 days and not older than 3 years (smallpox) or 10 years (yellow fever). Such vaccination certificates must also be presented to German authorities if you return from certain countries (e.g., Africa, Middle East).
16. General
The invalidity of individual provisions of the package travel contract does not affect the validity of the entire package travel contract. The same applies to these travel conditions.
